At the annual National Advertising Law Conference 2009, chaired by Ebba Hoogenraad, it was announced that a new, broader definition for advertising will apply in the Dutch Advertising Code. It will also take into account the new technologies. A change is proposed that advertising can also cover non-public announcements to encourage sales. Current procedure that the advertising statement should be made in public, was part of the definition up until now. Under the new definition - still a draft - a one-to-one statement or an e-mail to a single person with a promotional objective for a product or service will be subjected to the Dutch Advertising Code. This will entail very far-reaching changes. The final word is not spoken on this matter! The changes will take effect in January 2010. Ebba Hoogenraad speeched at the conference about actual decisions on the threshold between advertising and information. Also the questions was raised - and solutions given – about the disclaimer "Loaning money, costs money".
