The Dutch website Gaspedaal.nl must immediately cease to show second hand car ads that were first published on Autotrack.nl. Autotrack.nl is one of the best known Dutch car ad sites, belonging to the Wegener publishing group. This follows from a judgment given by the District Court of The Hague earlier this week.
Every time a query is requested on Gaspedaal.nl relating to a specific type, colour, year and so on, a ‘dedicated meta search engine’ searches a few sites on the web selected by Gaspedaal.nl. "The cumulative effect of the many queries trough Gaspedaal.nl is that a substantial part of Wegener's database is provided to the public," so condidered the Court. In 2007, the Utrecht Court ruled in a temporary judgment that Gaspedaal.nl was not infringing Wegener's database rights.
The judgment is an important victory for Wegener, which heavily invested in Autotrack.nl. Following sites like Gaspedaal.nl will now profit less easily from these investments. The judgment affects the position of other sites collecting data from third party sites by use of dedicated search engines. Companies like Ebay and the Dutch real estate site Funda have a good week.
