The Daihatsu advertisement "€ 500 discount ON ALL models" is misleading, the Advertising Standard Committee recently judged. In the end the discount was not supplied. The red Daihatsu Curore were not, as it happens, in stock during the sales promotion. And therefore the purchaser missed the discount, since the other available colours were not of interest to the purchaser.
Being mentioned in the general conditions that the action lasted only as long as the product was in stock, was not sufficient. Not giving clear information concerning the availability of the product is an unfair commercial practice and is considered an unlawful act.
In the advertisement should at least been mentioned: `as far as available in stock'.
The impact of the tightened up legislation concerning unfair and misleading commercial practices starts to outline itself. The most important "bottem line" must be put IN the advertisements!
