An ad which says that the jackpot “will fall” does not mean that the entire amount will be paid to the winner. The winner with a 1/5 lot gets 'only' 1/5 part. Yet that is not misleading according to the Board of Appeal. There is a textual difference between 'fall' and 'pay out'. Consumers can easily get to know on the website and by the points of sales of the State Lottery that with a 1/5 lot the prize 'only' is 1/5 part (5.5 million). The Board of Appeal does have a more clement judgement than the Advertising Code Commission. Though the Board of Appeal admits that it would have been better if the information was given by the State Lottery. Meanwhile, the State Lottery mentions the additional information on the shelters and in television commercials.
