Kruidvat launched a nationwide price action with Björn Borg boxershorts with a discount from € 21.95 to € 14.99. Unfortunately, the public urged to the Kruidvat in vain. This is a misleading trade practice. Why? The Board of Appeal considered that Kruidvat distributed 6 million copies of their advertising leaflet. The Björn Borg boxers were offered in sizes S-XL, in different colors. Distributed to their 800 branches, it came down to 36 boxer shorts per shop, and 0.64 (!) shorts for each size and color. This is not enough, given the popularity of the product, the size of the advertisement and the price offered. According to the Board of Appeal this is an example of a black-listed trade practice: under all circumstances 'bait advertising' is prohibited. Advertising at a given price while the advertiser knows that he is, for a reasonable period, short on stock of the product.
And Björn Borg? He called on all his customers to buy all short in their local Kruidvat Branches and return them to Björn Borg Netherlands. An effective customer-driven recall...
