27 november 2018 - Smaak is uniek en persoonlijk. En ieder beleeft het weer anders. De smaak van een levensmiddel kan niet op basis van het auteursrecht worden gemonopoliseerd. Waarom niet? Omdat die smaak (nog) niet nauwkeurig en objectief kan worden vastgesteld.
Het Hof van Justitie EU heef eindelijk uitspraak gedaan. Fabrikant Levola brengt al jaren een smakelijke Smeerdip Heksenkaas op de markt. Toen kwam concurrent Smilde met de Witte Wieven-smeerdip op de markt. Levola probeerde dit een halt toe te roepen op basis van auteursrecht op de smaak van haar smeerdip. De principiële hamvraag is of wel auteursrecht op smaak kan bestaan? Nee, zegt het Hof: bij de huidige stand van de wetenschap is het nu nog niet mogelijk om met behulp van techniek de smaak van een voedingsmiddel nauwkeurig en objectief vast te stellen. Het is dus wachten op technische vooruitgang. En dan kan misschien ooit wél de smaak van een product auteursrechtelijk beschermd worden …
Ondertussen blijven onderlinge smaakvergelijkingen in reclamecampagnes zeker mogelijk. Daarbij moet de adverteerder wel goed beslagen ten ijs komen. Meer weten over de Heksenkaas smaak-zaak, en over wat wél kan is in vergelijkende smaak-reclames?
